Century Homebuilders faces legal battle over alleged fraudulent transfers before founder’s death

Sergio Pino’s widow, Tatiana Pino, and their daughters have filed a lawsuit against Nancy Pastor, Pino’s longtime girlfriend, as well as other individuals connected to alleged fraudulent transfers of property interests in the days surrounding Pino’s death. The complaint was submitted last week in Miami-Dade Circuit Court and also names Century Midtown Club and Fitness Center LLC, attorney Eugenio Duarte, and Joseline Pereira, former CFO of Century Homebuilders.

Sergio Pino was a well-known homebuilder in South Florida and the founder of Century Homebuilders Group. He died by suicide in July 2024 while under investigation by federal authorities for allegedly attempting to murder his wife through poisoning and hiring hitmen. At the time of his death, Sergio and Tatiana were going through a contentious divorce.

The dispute centers on actions involving Century Midtown, a mixed-use development in Doral with condos, apartments, and a clubhouse. According to court filings, Nancy Pastor had been involved with Sergio Pino since the early 2000s.

The lawsuit claims that trust and lease documents related to Century Midtown were created or amended without proper consent during March and July 2024. “In July 2024 as Sergio Pino’s multi-year efforts to kill Tatiana, his joint partner/owner by the entireties of CHG, failed, and with the FBI and the police closing in, certain documents related to the collateralized clubhouse were purportedly executed by Sergio without the consent of the bank, his project partners, Tatiana, or those he sought to transfer control to all of his interests in Century Fitness and the Clubhouse, among other things,” according to the complaint.

Tatiana Pino and her daughters allege these documents—a 99-year lease agreement along with two trusts—were intended to benefit Pastor improperly. “These efforts were criminal, fraudulent, intentional and otherwise wrongful,” states their lawsuit.

Nancy Pastor’s attorney Michael Schlesinger provided a statement to The Real Deal: “To set the record straight, for over the past decade that Ms. Pastor was affiliated with Mr. Pino’s businesses and ventures she never witnessed Ms. [Tatiana] Pino involved in any business transaction until she took over after his untimely death,” he said. “Ms. Pastor has never done anything illegal and has always been ethical and transparent in all Estate matters.” Schlesinger added that Pastor did not receive copies of any trusts until after Sergio’s death: “Pastor’s successful efforts in the sales and management of Sergio Pino projects led to Mr. Pino and his companies profiting by millions” explaining her management roles were due to her experience.

According to allegations from Tatiana Pino’s legal team, metadata shows one trust document signed March 11 was actually created on March 13—around when Sergio reportedly learned about law enforcement interest into an alleged murder plot against Tatiana; another trust is dated just one day before his death.

The complaint includes an email from attorney Duarte raising concerns about possible negative effects from rushed changes: “Each transfer, assignment appointment etc., can potentially alter the relationship with third parties (or even require consent…) we have to be careful not to make any decisions in haste without considering all possible consequences… I am concerned some changes are not needed… they may bring detrimental consequences.”

Ownership questions regarding three properties at Northwest 107th Avenue are now complicating potential sale or refinancing options for Century Town Center. The brokerage CBRE has been engaged but so far has been unable to secure refinancing because lenders have found current partners unacceptable as guarantors; this could force either a sale or recapitalization with new investors.
